ayotte proposes amendment 3245. ms. ayotte: thank you very much. i rise in support of my amendment 3245. last year in the defense authorization bill we had in it a prohibition that would prohibit transferring those thosh held in -- who are knelled custody at the guantanamo bay facility from there to the united states of america. this year as the language of the defense authorization stands, there is no such prohibition in that, making it possible for the administration, should it choose, to transfer from the guantanamo bay detention facility 166 foreign enemy combatants that are currently being detained at guantanamo. i am deeply, deeply concerned that the defense authorization does not include this prohibition of transfer language, and that is why i have brought forth this amendment. i'm also pleased this amendment is being cosponsored by the vice chairman of the senate select committee on intelligence, senator chambliss, as well as senators inhofe, graham, kirk and senator sessions. we have at guantanamo bay a top-rate facility that allows for th

senator kyl and ayotte. last year i asked for and obtained language in the defense bill that would require the defense department to report on the effectiveness and need and ramifications of a hedging strategy for the united states. and that was due in 75 days of the bill being passed. my understanding is the defense department produced that analysis and they've sent it to the white house as early as last spring and it has not been produced. so now we have the house having passed language that actually funds moving forward with a hedging strategy on an american-based system to give us layered defense, which i think is probably necessary. but because we've not gotten a report from the defense department, it's hard to know. and so i would first say that it's not acceptable that we've not received that report and it's gone on too long. and i guess i in congress has been so retail pharmac reticentg that it be produced. so i would say to the administration, we expect that report to be produced. i don't want to ca
